Terms of sitting

These terms govern assessments booked with Toolkitnest in George Town: reviews, briefings, pre-launch plans, and monthly interpretation of fitness tracking apps.

These terms apply when you book a sitting with Toolkitnest (“we”, “us”) from Office 8, 29 Example Avenue, George Town 00000. By sending a booking note or paying a deposit you accept them. If a signed letter of engagement disagrees with this page, the letter wins for that sitting only.

The work

We provide professional readings of app analytics for fitness tracking apps: full reviews, member retention readings, coach briefings, pre-launch measurement plans, and monthly interpretation. We do not sell software, process card payments, or take custody of your members. Scope is confirmed in writing after the intake call.

Your part

You supply a lawful sample of workout logs and class check-ins, with permission from the people those logs describe or with names removed. You do not send us medical diagnoses, payment credentials, or passwords to administrative accounts. If a floor morning is booked, you arrange access and tell staff we will be present.

Fees and invoices

Fees are in Malaysian ringgit as described on the rates page or in the engagement letter. A 40% deposit holds dates for reviews, briefings, and pre-launch plans. Monthly interpretation is billed before the month begins. Bank transfer is the ordinary method. Work already started is billed as set out in the refund notice.

Intellectual property

The written reading we prepare is licensed to you for internal use: staff meetings, coach briefings, and conversations with your app vendor. You may not republish it as a marketing claim about retention or sell it as a template. Our methods, question lists, and blank sheets remain ours. Your workout logs remain yours.

Confidentiality

We treat studio names, unpublished log samples, and draft copy as confidential for three years after the last sitting, except where the law requires disclosure or you ask us in writing to speak to a vendor. Testimonials on this site were approved by the people named.

Liability

We read training records; we do not prescribe exercise, diagnose injury, or guarantee membership numbers. Our liability for a sitting is limited to the fees you paid for that sitting, except where Malaysian law forbids a limit (for example, death or personal injury caused by negligence, or fraud). We are not liable for lost profit, lost members, or a vendor’s delay in changing a screen.

Governing law

These terms are governed by the laws of Malaysia. Courts in Penang have exclusive jurisdiction, unless a mandatory consumer rule in Malaysia says otherwise.

Changes
